Safety, Participation & Responsibility Terms

Scope, Coverage & Applicability

These Safety, Participation & Responsibility Terms apply to all individuals, without limitation, involved in or present at any activity, tour, rental, or yacht charter presented under the 360 Adventure Group brand.

This includes all participants and non-participants, of any age, including adults, minors, infants, and babies, whether actively participating or present in the activity environment in any capacity.

These terms apply to all activities, tours, rentals, charters, environments, locations, vessels, equipment, and circumstances, including but not limited to surf lessons, kayak and paddleboard tours, bike rentals, yacht charters, beaches, docks, marinas, vehicles, watercraft, and surrounding public or private areas.

360 Adventure Group is a brand and operating group name used to present multiple independently operated adventure services. It is not a registered legal entity, does not accept payments, and does not directly provide services.

All services are delivered and operated by the specific business with which the individual books, rents, or charters. Responsibility for service delivery rests solely with the operating business.

Participation, Inherent Risks & Personal Responsibility

Participation in outdoor, water-based, marine, and adventure activities is voluntary. Individuals acknowledge that such activities involve normal and inherent risks that cannot be fully eliminated, even when conducted responsibly.

These inherent risks may include, without limitation, property damage, personal injury, serious injury, illness, or death.

Each individual assumes full responsibility for assessing their own abilities, physical condition, and readiness to participate or be present under the conditions existing at the time of the activity.

Physical Readiness & Health

All individuals confirm they are physically and medically capable of participating or being present in the activity environment. Any relevant medical conditions, injuries, limitations, or special needs must be disclosed in advance.

The operating business reserves the right to restrict, modify, or refuse participation, rental, charter, or presence if a person’s condition or behavior is deemed unsafe.

Environmental & Operational Conditions

Activities occur in dynamic environments where weather, wind, waves, currents, visibility, sea state, traffic, or operational conditions may change at any time.

For safety or operational reasons, the operating business may adjust routes, locations, timing, duration, staffing, equipment, or cancel activities at its discretion.

Guide, Instructor & Captain Authority

All activities are conducted under the authority of guides, instructors, captains, or staff. Their instructions are mandatory and must be followed at all times.

Failure to comply with instructions or behavior that compromises safety may result in removal from the activity, rental, tour, or vessel without refund.

Equipment, Vessels & Property Use

Any equipment, vessels, boards, bicycles, or gear provided must be used only as instructed and for its intended purpose. Individuals are responsible for damage caused by misuse, negligence, or failure to follow instructions.

Timing, Attendance & No-Shows

Activities operate on fixed schedules. Individuals are responsible for arriving on time and completing any required check-in procedures.

Late arrival, absence, or failure to check in may result in a shortened or missed activity. Deposits or payments may be forfeited according to the operating business’s policies.

Photography & Media

Photos or video footage may be taken during activities for operational, safety, or promotional purposes. Individuals may notify staff in advance if they prefer not to appear.

Medical Authorization

In the event of illness or injury where an individual is unable to communicate, permission is granted for staff to seek or authorize emergency medical care. All medical costs remain the responsibility of the individual or their legal guardian.

Minors, Infants & Parental Responsibility

For any individual under 18 years of age, including infants and babies, a parent or legal guardian assumes full and complete responsibility for the minor’s participation, presence, supervision, conduct, and safety at all times.

This responsibility applies whether the minor is actively participating or present as a passenger, observer, or accompanying individual.

Agreement to Terms

By booking, renting, chartering, participating in, joining, attending, or being present at any activity, tour, rental, or yacht charter presented under the 360 Adventure Group brand, all individuals expressly acknowledge and agree to these Safety, Participation & Responsibility Terms.

Agreement to these terms is a condition of participation, rental, charter, or presence. Individuals who do not agree must not participate, rent equipment, join tours, board vessels, or be present in the activity environment.

I. The 360 Surf Guarantee Policy Terms

At 360 Surf School Cancun, we are dedicated to your success. Our coaches are committed to getting you riding, which is why we offer our industry-leading guarantee:
"The 360 Guarantee: Stand and surf, or receive a free surf lesson."
To ensure we maintain the highest standard of instruction and respect for our guests' time, the following policies apply:

Defining "Surfing": For the purpose of this guarantee, surfing is defined as the successful ability to move from a prone (laying) position to standing upright on the surfboard with both feet while being propelled by a wave.
The Goal Achieved: Once a surfer makes it to their feet, the goal of the lesson is considered successfully met, regardless of the duration they remain upright (whether it is a split second or 5 seconds). If you have stood on the board while being pushed on a wave, you have surfed!
Individual Performance & Professional Responsibility: Surfing, like any sport, is a skill that varies by individual. Furthermore, water conditions—such as waves, currents, and water movement—are constantly changing and are beyond our control. We are responsible for providing expert instruction, high-quality equipment, and a safe environment—which we have done. Because we have provided the service you booked, we cannot offer a refund for your performance, as results depend on individual ability and external conditions beyond our control.
The Guarantee Protocol: In the rare instance that an individual guest does not successfully stand on the board during their lesson, they will be gifted one complimentary return surf lesson. This guarantee applies only to that specific individual and does not extend to the rest of their group.
No Refunds: All payments and deposits are final. Once a lesson has been provided, no cash refunds will be issued under any circumstances.
Non-Transferable: This guarantee is exclusive to the original student who was unsuccessful. It is not transferable to other individuals (including other group members), cannot be sold or traded, and holds no cash value. The complimentary return lesson is subject to instructor availability and must be booked at the instructor’s discretion during the guest's current stay in Cancún.

II. Surfboard & Equipment Rental Agreement

By renting equipment, you agree that you are solely responsible for its care and for your own safety.

Finality of Rental: All rental fees are earned the moment the equipment is handed over. There are no refunds for "bad" weather, unfavorable water conditions, or if you choose not to use the equipment. You are responsible for assessing the environment and your own skill level before renting.
Waiver of Liability: Surfing is an extreme sport. By renting, you assume 100% of the risk of personal injury, permanent disability, or death. You waive any right to hold 360 Surf School, 360 Surf Shop, its owners, or employees liable for any injuries, regardless of whether those injuries were caused by equipment failure, lack of supervision, or environmental hazards.
Equipment Protection & Responsibility:
- "You Break It, You Buy It": Any damage to the surfboard (dings, creases, delamination) or loss/damage of the leash or fin is the sole financial responsibility of the renter.
- Theft or Loss: You are responsible for the equipment at all times until it is returned to a staff member. In the event of theft, loss, or disappearance—regardless of the circumstances—you are responsible for the full replacement cost. "It was stolen from the beach" is not a valid reason for avoiding charges.
- Credit Card Authorization: By signing, you authorize 360 Surf Shop to charge your credit card on file for any damages, theft, or unreturned equipment at full replacement value (as determined by 360 Surf Shop management) plus administrative costs.
- Inspection Period: You agree that you have thoroughly inspected the equipment upon receipt. Any damage present upon return that was not noted at the time of pickup will be deemed to have occurred during your rental period

III. General Terms & No-Refund Policy

No Refunds: All payments and deposits are final. Once a service or rental has been provided, no cash refunds will be issued under any circumstances.
No Precedent: Any courtesy extension or equipment swap granted to a guest in the past (or future) is a one-time gesture of goodwill. It does not establish a precedent, policy, or contractual right for any future claims.
Agreement to Terms: By completing your booking, you acknowledge that you have read and agree to the 360 Surf Shop Safety, Policies, and Terms of Service, including the 'No-Refund' and 'Damage/Theft Responsibility' clauses. All rentals are final.

IV. SUP & Kayak Tour Rules & Regulations

By participating in a 360 Adventure Group tour, you agree to the following strict safety protocols. Failure to adhere to these rules may result in the immediate termination of your tour without refund.

Instruction & Compliance: You agree to follow all instructions provided by your guide at all times. The guide has absolute authority regarding safety, route adjustments, and group management. If your behavior is deemed unsafe, disruptive, or you refuse to follow instructions, you will be required to leave the water immediately.
The "Stay Together" Rule: For safety, the group must remain within visual and vocal contact range of the guide at all times. Do not paddle ahead or wander off alone.
Required Safety Gear: All participants must wear a US Coast Guard-approved Personal Flotation Device (PFD) at all times while on the water. No exceptions will be made, regardless of swimming ability.
Physical & Medical Disclosure: By participating, you represent that you are in good health, a capable swimmer, and physically fit to engage in strenuous paddle sports. You must disclose any medical conditions (e.g., heart issues, back injuries, pregnancy) to our staff before the tour begins. 360 Surf School reserves the right to deny participation to anyone who appears physically unable to complete the tour safely.
Sobriety Policy: Consumption of alcohol or drugs before or during the tour is strictly prohibited. Anyone showing signs of impairment will be barred from the tour without refund.
Environmental & Personal Responsibility:
- Changing Conditions: Weather and water conditions in Cancún can shift rapidly. You acknowledge that our guides evaluate conditions for safety, but you participate at your own risk.
- Equipment Care: You are responsible for the paddleboard or kayak assigned to you. Any damage resulting from reckless use or negligence (e.g., dragging boards over coral or rocks) will be charged to your account.
Zero-Tolerance for Recklessness: Activities such as "ditching" your board, jumping from the kayak in unsafe areas, or interacting aggressively with marine life are strictly forbidden and grounds for tour termination.

V. Bike Rental: Waiver, Liability, & Safety Agreement

By renting a bicycle from 360 Adventure Group, you enter a binding legal agreement. Cycling in an urban or tourist environment carries significant inherent risks. By completing your booking, you confirm that you are solely responsible for your safety and the safety of the equipment.
1. Assumption of Risk & Waiver of Liability

Extreme Risk: Cycling involves risks of severe injury, permanent disability, or death, including but not limited to collisions with motor vehicles, pedestrians, or road hazards (potholes, debris, uneven surfaces).
Total Release: You voluntarily assume 100% of all risks associated with bicycle rental. You waive any right to bring legal action against 360 Adventure Group, its owners, or employees for any accident, injury, or death, regardless of the cause (including alleged mechanical failure or lack of safety equipment).
Traffic Compliance: You are responsible for knowing and obeying all local traffic laws. 360 Adventure Group is not liable for any fines, legal issues, or accidents caused by your failure to follow local regulations.

2. The "Condition & Picky Renter" Clause

Pre-Ride Inspection: You must inspect the bike (brakes, tires, chain, frame) before leaving our location. By riding away, you certify that the bike is in 100% safe, working order.
Performance Satisfaction: We do not offer refunds because you find the bike "uncomfortable," "too heavy," "not the right style," or "not what you expected." You are welcome to test-ride the bike at our location before finalizing your rental time. Once you depart with the bike, the rental is final and non-refundable.

3. Equipment Protection, Theft & Damage

Theft is Your Responsibility: You are 100% responsible for the bike at all times. If the bike is stolen—even if locked—you are liable for the full current retail replacement value plus administrative costs. "I locked it, but they stole it anyway" is not a valid excuse to avoid payment.
Damage Policy: You are responsible for any damage to the bike, including bent rims, broken spokes, or damaged frames. If you damage the bike, you will be billed for the cost of professional parts and labor.
Credit Card Authorization: By signing, you authorize 360 Adventure Group to charge your card on file for any theft, loss, or repair costs at our sole discretion.

4. Strict Enforcement & No-Refunds

No Refunds for "Conditions": We do not provide refunds for rain, heat, humidity, or "too much traffic." You are responsible for checking the weather and road conditions before renting.
No Precedent: Any assistance provided in the past (e.g., swapping a bike because a guest changed their mind) is a one-time courtesy and does not establish a right to future swaps or refunds.
Agreement: By booking, you acknowledge that you have read and agree to these terms. All rentals are final.

VI. Guided Bike Tour: Rules, Regulations & Liability

By participating in a 360 Adventure Group bike tour, you acknowledge that you are part of an organized activity with inherent risks. You agree to the following strict safety protocols:

Absolute Guide Authority: Your guide has absolute authority over the group. This includes the right to stop the tour, change the route, or terminate the participation of any guest who fails to follow instructions, behaves recklessly, or poses a safety risk to themselves or others. No refunds will be issued for terminated tours.
The "Group Integrity" Rule: For your safety, the group must remain together. You must follow the designated path and stay behind the lead guide at all times. Wandering off the route is strictly prohibited and grounds for immediate removal from the tour.
Zero-Tolerance for Recklessness: The following behaviors are strictly forbidden: weaving in and out of traffic, riding on sidewalks where prohibited, racing, "popping wheelies," hands-free riding, or using mobile phones while the bike is in motion.
Medical & Physical Fitness: By joining the tour, you represent that you are physically capable of completing the ride. If you have medical conditions (e.g., asthma, heart conditions, joint issues), you must disclose them to the guide before departure. We reserve the right to deny participation to anyone who appears physically unfit to handle the tour route.
Inclement Weather & Road Conditions: Cycling conditions change. We may modify the route, shorten the tour, or delay departure for safety reasons. We do not provide refunds or credits for tours modified due to weather, road construction, or other external conditions beyond our control.
Responsibility for Others: You are responsible for any damage you cause to third parties or their property while on the tour. 360 Adventure Group is not liable for your personal actions or interactions with pedestrians, vehicles, or animals during the tour.
No Sobriety, No Tour: Any guest suspected of being under the influence of alcohol or drugs will be refused participation without refund.

Términos de Seguridad, Participación y Responsabilidad

Alcance, Cobertura y Aplicación

Estos Términos de Seguridad, Participación y Responsabilidad se aplican a todas las personas, sin limitación alguna, que participen o estén presentes en cualquier actividad, tour, renta o charter de yate presentado bajo la marca 360 Adventure Group.

Esto incluye a todos los participantes y no participantes, de cualquier edad, incluidos adultos, menores de edad, bebés e infantes, ya sea que participen activamente o simplemente estén presentes en el entorno de la actividad.

Estos términos se aplican a todas las actividades, tours, rentas, charters, entornos, ubicaciones, embarcaciones, equipos y circunstancias, incluidos, entre otros, clases de surf, tours de kayak y paddleboard, renta de bicicletas, charters de yates, playas, muelles, marinas, vehículos, embarcaciones y áreas públicas o privadas relacionadas.

360 Adventure Group es un nombre de marca y grupo operativo utilizado para presentar múltiples servicios de aventura operados de manera independiente. No es una entidad legal registrada, no acepta pagos ni presta servicios directamente.

Todos los servicios son operados por la empresa específica con la que la persona realiza la reserva, renta o contratación. La responsabilidad del servicio recae exclusivamente en la empresa operadora.

Participación, Riesgos Inherentes y Responsabilidad Personal

La participación en actividades al aire libre, acuáticas, marinas y de aventura es voluntaria. Las personas reconocen que dichas actividades implican riesgos normales e inherentes que no pueden eliminarse por completo, incluso cuando se realizan de manera responsable.

Estos riesgos inherentes pueden incluir, sin limitación, daños materiales, lesiones personales, lesiones graves, enfermedades o fallecimiento.

Cada persona asume plena responsabilidad de evaluar sus propias capacidades, condición física y preparación para participar o estar presente bajo las condiciones existentes en el momento de la actividad.

Condición Física y Salud

Todas las personas confirman que se encuentran física y médicamente aptas para participar o estar presentes en el entorno de la actividad. Cualquier condición médica relevante, lesión, limitación o necesidad especial debe informarse con anticipación.

La empresa operadora se reserva el derecho de restringir, modificar o negar la participación, renta, contratación o presencia si considera que la condición o conducta de una persona representa un riesgo.

Condiciones Ambientales y Operativas

Las actividades se desarrollan en entornos dinámicos donde el clima, el viento, las olas, las corrientes, la visibilidad, el estado del mar, el tráfico u otras condiciones pueden cambiar en cualquier momento.

Por razones de seguridad u operación, la empresa operadora puede modificar rutas, ubicaciones, horarios, duración, personal, equipo o cancelar actividades a su discreción.

Autoridad del Guía, Instructor o Capitán

Todas las actividades se realizan bajo la autoridad de guías, instructores, capitanes o personal. Sus instrucciones son obligatorias y deben cumplirse en todo momento.

El incumplimiento de instrucciones o conductas que comprometan la seguridad puede resultar en la exclusión de la actividad, renta, tour o embarcación sin derecho a reembolso.

Uso de Equipos, Embarcaciones y Bienes

Todo equipo, embarcación, tabla, bicicleta o material proporcionado debe utilizarse únicamente conforme a las instrucciones y para su propósito previsto. Los daños causados por uso indebido o negligencia serán responsabilidad de la persona.

Horarios, Asistencia y Ausencias

Las actividades operan con horarios establecidos. Es responsabilidad de cada persona llegar puntualmente y completar cualquier procedimiento de registro requerido.

Llegadas tardías, ausencias o falta de registro pueden resultar en la pérdida parcial o total de la actividad, así como de depósitos o pagos conforme a las políticas de la empresa operadora.

Fotografía y Medios

Durante las actividades pueden tomarse fotografías o videos con fines operativos, de seguridad o promocionales. Las personas pueden notificar al personal si prefieren no aparecer.

Autorización Médica

En caso de enfermedad o lesión donde una persona no pueda comunicarse, se autoriza al personal a solicitar o autorizar atención médica de emergencia. Todos los costos médicos serán responsabilidad de la persona o de su tutor legal.

Menores, Bebés y Responsabilidad Parental

Para cualquier persona menor de 18 años, incluidos bebés e infantes, el padre, madre o tutor legal asume plena y total responsabilidad por la participación, presencia, supervisión, conducta y seguridad del menor en todo momento.

Esta responsabilidad aplica tanto si el menor participa activamente como si se encuentra presente como pasajero, observador o acompañante.

Aceptación de los Términos

Al reservar, rentar, contratar, participar, unirse, asistir o estar presente en cualquier actividad, tour, renta o charter de yate presentado bajo la marca 360 Adventure Group, todas las personas reconocen y aceptan expresamente estos Términos de Seguridad, Participación y Responsabilidad.

La aceptación de estos términos es una condición obligatoria para participar, rentar equipo, unirse a tours, abordar embarcaciones o estar presente en el entorno de la actividad. Las personas que no acepten estos términos no deben participar ni estar presentes.

360 Adventure Group: Seguridad, Políticas y Términos

Al reservar un servicio o alquilar equipo con 360 Surf School / 360 Surf Shop, reconoces que estás celebrando un acuerdo legal vinculante. Todos los participantes deben aceptar los siguientes términos y condiciones.
I. La Garantía 360En 360 Surf School, estamos dedicados a tu éxito. Nuestros instructores están comprometidos a que logres ponerte de pie sobre la tabla.

La Garantía: "Te pones de pie y surfeas, o recibes una clase de surf gratis."
Definiendo "Surfear": Para fines de esta garantía, surfear se define como la capacidad exitosa de pasar de una posición acostada a ponerse de pie sobre la tabla de surf con ambos pies mientras eres impulsado por una ola.
Objetivo cumplido: Una vez que el estudiante logra ponerse de pie, el objetivo de la clase se considera cumplido con éxito, independientemente de la duración que permanezca de pie (ya sea una fracción de segundo o 5 segundos). Si te has puesto de pie en la tabla mientras eras impulsado por una ola, has surfeado.
Desempeño, Resistencia y Satisfacción: El surf es un deporte físico que requiere esfuerzo y resistencia. Los resultados dependen de la habilidad individual, la resistencia personal y las condiciones externas —como las olas y corrientes— que cambian constantemente y están fuera de nuestro control. Nosotros somos responsables de proporcionar instrucción experta, equipo de alta calidad y un entorno seguro, lo cual hemos hecho. Debido a que hemos proporcionado el servicio que reservaste, no podemos ofrecer un reembolso por tu desempeño, ya que los resultados dependen de tu propia resistencia y habilidad.
Protocolo de la Garantía: En el raro caso de que un cliente individual no logre ponerse de pie sobre la tabla durante su clase, se le otorgará una clase de surf de cortesía. Esta garantía se aplica únicamente a esa persona específica y no se extiende al resto de su grupo.
No transferible: La clase de cortesía es exclusiva para el estudiante original. No es transferible, no tiene valor en efectivo y no puede ser vendida ni intercambiada. Está sujeta a la disponibilidad del instructor y debe reservarse a discreción del mismo durante la estancia actual del cliente en Cancún.

II. Acuerdo de Alquiler de Tablas de Surf y EquipoAl alquilar equipo, aceptas que eres el único responsable de su cuidado y de tu propia seguridad.

Finalidad del Alquiler: Todas las tarifas de alquiler se consideran ganadas en el momento en que se entrega el equipo. No hay reembolsos por mal tiempo, condiciones desfavorables del agua o si decides no utilizar el equipo. Eres responsable de evaluar el entorno y tu propio nivel de habilidad antes de alquilar.
Exención de Responsabilidad: El surf es un deporte extremo. Al alquilar, asumes el 100% del riesgo de lesiones personales, discapacidad permanente o muerte. Renuncias a cualquier derecho de responsabilizar a 360 Surf School, 360 Surf Shop, sus propietarios o empleados por cualquier lesión, independientemente de si fue causada por falla del equipo, falta de supervisión o peligros ambientales.
Protección y Responsabilidad del Equipo:
- "Si lo rompes, lo pagas": Cualquier daño a la tabla de surf (golpes, grietas, delaminación) o pérdida/daño de la correa (leash) o quilla es responsabilidad financiera exclusiva del arrendatario.
- Robo o Pérdida: Eres responsable del equipo en todo momento hasta que sea devuelto a un miembro del personal. En caso de robo, pérdida o desaparición —independientemente de las circunstancias— eres responsable del costo total de reemplazo. "Me lo robaron de la playa" no es una razón válida para evitar estos cargos.
- Autorización de Tarjeta de Crédito: Al firmar, autorizas a 360 Surf Shop a realizar un cargo en tu tarjeta de crédito por cualquier daño, robo o equipo no devuelto al valor total de reemplazo (determinado por la gerencia de 360 Surf Shop) más los costos administrativos.
- Período de Inspección: Aceptas que has inspeccionado minuciosamente el equipo al recibirlo. Cualquier daño presente al devolverlo que no haya sido anotado en el momento de la entrega se considerará ocurrido durante tu período de alquiler.

III. Términos Generales y Política de No Reembolso

Sin Reembolsos: Todos los pagos y depósitos son finales. Una vez proporcionado el servicio o alquiler, no se emitirán reembolsos en efectivo bajo ninguna circunstancia.
Sin Precedentes: Cualquier extensión de cortesía o cambio de equipo otorgado a un cliente en el pasado (o futuro) es un gesto de buena voluntad único. No establece un precedente, política o derecho contractual para futuras reclamaciones.
Acuerdo de Términos: Al completar tu reserva, reconoces que has leído y aceptas los términos de seguridad, políticas y condiciones de servicio de 360 Surf Shop, incluyendo las cláusulas de "No Reembolso" y "Responsabilidad por Daño/Robo". Todos los alquileres son finales.

IV. Reglas y Regulaciones para Tours de SUP y Kayak

Al participar en un tour de 360 Adventure Group, aceptas las siguientes normas de seguridad estrictas. El incumplimiento de estas reglas puede resultar en la terminación inmediata de tu tour sin derecho a reembolso.

Instrucciones y Cumplimiento: Aceptas seguir todas las instrucciones proporcionadas por tu guía en todo momento. El guía tiene autoridad absoluta en temas de seguridad, ajustes de ruta y manejo del grupo. Si tu comportamiento se considera inseguro, disruptivo o te niegas a seguir las instrucciones, se te pedirá que salgas del agua inmediatamente.
Regla de "Mantenerse en Grupo": Por seguridad, el grupo debe permanecer en todo momento dentro del rango visual y auditivo del guía. No remes por delante ni te alejes del grupo.
Equipo de Seguridad Obligatorio: Todos los participantes deben usar un chaleco salvavidas (PFD) aprobado por la Guardia Costera en todo momento mientras estén en el agua. No se harán excepciones, independientemente de la capacidad de nado del participante.
Divulgación Física y Médica: Al participar, declaras que gozas de buena salud, que eres un nadador capaz y que estás físicamente apto para realizar deportes de remo extenuantes. Debes informar al personal sobre cualquier condición médica (ej. problemas cardíacos, lesiones de espalda, embarazo) antes de comenzar el tour. 360 Adventure Group se reserva el derecho de negar la participación a cualquier persona que, a juicio del personal, no sea físicamente capaz de completar el tour de manera segura.
Política de Sobriedad: El consumo de alcohol o drogas antes o durante el tour está estrictamente prohibido. Cualquier persona que muestre signos de estar bajo la influencia de sustancias será excluida del tour sin derecho a reembolso.
Responsabilidad Ambiental y Personal:
- Condiciones Cambiantes: Las condiciones climáticas y del agua en Cancún pueden cambiar rápidamente. Reconoces que, aunque nuestros guías evalúan las condiciones para garantizar la seguridad, participas bajo tu propio riesgo.
- Cuidado del Equipo: Eres responsable de la tabla de paddleboard o kayak que se te asigne. Cualquier daño resultante de un uso imprudente o negligente (ej. arrastrar tablas sobre coral o rocas) será cargado a tu cuenta.
Tolerancia Cero con la Imprudencia: Actividades como "abandonar" la tabla, saltar del kayak en áreas inseguras o interactuar agresivamente con la vida marina están estrictamente prohibidas y son motivo de terminación del tour.

V. Alquiler de Bicicletas: Exención de Responsabilidad, Seguridad y AcuerdoAl alquilar una bicicleta con 360 Adventure Group, aceptas que eres el único responsable de tu seguridad y del equipo.

Asunción de Riesgos: El ciclismo conlleva riesgos de lesiones graves, discapacidad permanente o muerte. Al alquilar, asumes el 100% de todos los riesgos. Renuncias a cualquier derecho de demandar a 360 Adventure Group por cualquier accidente o lesión, independientemente de la causa.
Cumplimiento de Leyes: Es tu responsabilidad conocer y obedecer las leyes de tránsito. No somos responsables de multas ni accidentes causados por tu negligencia.
Inspección y Satisfacción: Debes inspeccionar la bicicleta antes de salir de nuestras instalaciones. Al retirarte con la bicicleta, certificas que está en perfecto estado. No ofrecemos reembolsos por "incomodidad" o porque la bicicleta "no es lo que esperabas". Una vez que sales de la tienda, el alquiler es final.
Robo y Daño: Eres responsable de la bicicleta en todo momento. En caso de robo, eres responsable del costo total de reemplazo, incluso si la bicicleta estaba asegurada con candado. "Me la robaron" no es una excusa válida para evitar el pago. Autorizas a 360 Adventure Group a cargar en tu tarjeta de crédito cualquier costo por daño, robo o pérdida a nuestro criterio.
Sin Reembolsos por Condiciones: No hay reembolsos por mal tiempo, calor o condiciones de tráfico. Al completar tu reserva, aceptas que has leído y estás de acuerdo con estos términos. Todos los alquileres son finales.

VI. Tour Guiado en Bicicleta:

Reglas, Regulaciones y ResponsabilidadAl participar en un tour en bicicleta de 360 Adventure Group, aceptas los siguientes protocolos de seguridad:

Autoridad Absoluta del Guía: El guía tiene autoridad total sobre el grupo. Esto incluye el derecho a detener el tour, cambiar la ruta o terminar la participación de cualquier cliente que no siga las instrucciones, actúe de manera imprudente o ponga en riesgo la seguridad. No se otorgarán reembolsos por tours terminados debido a mal comportamiento.
Regla de "Integridad del Grupo": Por tu seguridad, el grupo debe permanecer unido. Debes seguir el camino designado y permanecer detrás del guía en todo momento. Alejarse de la ruta está estrictamente prohibido y es motivo de expulsión inmediata del tour.
Tolerancia Cero con la Imprudencia: Están estrictamente prohibidos comportamientos como: zigzaguear entre el tráfico, conducir por aceras prohibidas, competir, hacer caballitos, soltar el manubrio o usar el teléfono móvil mientras la bicicleta está en movimiento.
Fitness Físico y Médico: Al unirte al tour, declaras que estás físicamente capacitado para completar el recorrido. Si tienes condiciones médicas, debes informarlo al guía antes de la salida. Nos reservamos el derecho de negar la participación a quien consideremos que no está apto físicamente para realizar la ruta.
Condiciones Climáticas y del Camino: Las condiciones de ciclismo cambian. Podemos modificar la ruta o retrasar la salida por seguridad. No ofrecemos reembolsos ni créditos por tours modificados debido al clima, obras viales u otras condiciones fuera de nuestro control.
Responsabilidad ante Terceros: Eres responsable de cualquier daño que causes a terceros o a su propiedad durante el tour. 360 Adventure Group no es responsable por tus acciones o interacciones con peatones, vehículos o animales.
Sobriedad: Cualquier persona bajo la influencia de alcohol o drogas será rechazada sin derecho a reembolso.
